Comelec dismisses protest of Charlie Chong against Gov. Gerry Boy Espina. HRET might release next week the decision on Glenn Chong vs. Roger Espina electoral case.
The above calculations show that, even if all of Protestant’s claims from the rejected ballots were granted and all his objections to Protestee’s ballots were accepted, while all of Protestee’s claims from the rejected ballots were denied, Protestee would still be leading Protestant. Even under the best scenarios for, Protestant, Protestee still beats him by four hundred seventy-three (473) votes.
All told, We find that Protestant has failed to establish the merit or legitimacy of his election protest from his pinpointed pilot clustered precincts. We find no more need to proceed with the recount of the rest of his protested clustered precincts.
WHEREFORE, the Protest filed by Protestant, Charles P. Chong is hereby DISMISSED, without further preceedings, for LACK OF MERIT.
SO ORDERED,
Given this 9th day of October 2012, City of Manila, Philippines.
