TUCDAO ENCOUNTER. This is the text of the initial incident report filed by the PNP in Kawayan, which we quoted verbatim, including wrong spellings. Our reporter at the scene who has conducted interviews noticed some inconsistencies, including the reported time of the incident, and counter-claims of both sides blaming the other group for having started the incident. But an official report is an official report.

A person named Norbert Nierras, a driver of Kawayan Mayor Rudy Espina was wounded in the encounter and is now in critical condition at the Biliran Provincial Hospital.

TUCDAO, Kawayan, Biliran – An armed encounter took place on Saturday, May 11, at approximately 10 in the morning in Barangay Tucdao, Kawayan in Biliran province with only three days left before the synchronized May 13, 2013 national and local elections.

According to Jose Dagandan in an interview with Biliranisland.com, a resident of Barangay Tucdao who witnessed when the encounter happened, he saw a pick-up type Toyota Hilux car tailing a Toyota Fortuner car along the national highway in the vicinity of the barangay.

Dagandan narrated that he saw the Toyota Hilux turned to a road in said barangay and all of a sudden fired a shot on the Toyota Fortuner that already stopped at that time.

He said that the persons on board the Toyota Hilux numbering to four continued firing at the Toyota Fortuner while it was running on reverse away from the crime scene.

An ambulance has arrived in the area and the Toyota Hilux immediately run away from the area where the incident happened, he added.

The witness also told he was not able to identify the plate number of the Toyota Hilux because the people living near the area including him have hide because of fear and for their safety.

He also saw a person alighted from the Toyota Fortuner and immediately rolled on the ground and run for safety in a house near the road.

On the other hand, the driver of the Toyota Fortuner owned by former Congressman Glenn Chong named Edgar told Biliranisland.com that the Toyota Hilux with plate number 888 owned by Rudy Espina, was already tailing them in Barangay Ungali while they bought candies in a store in said barangay.

Edgar said the Toyota Hilux proceeded to Barangay Ungali but was just parked and waiting in the entrance arc structure of the barangay.

The Toyota Fortuner passed by the Toyota Hilux on standby but then the latter continue tailing them until they reached Barangay Tucdao where they went to a certain Edu, he further said.

He added that the Toyota Hilux passed at them, came back and parked in the waiting shed of the barangay and then a person alighted from the Toyota Hilux and fired at them once.

The driver of the Toyota Fortuner said that he alighted from his vehicle after the first shot and run at the back of a house for his safety leaving a certain Sir Pat on the vehicle.

Edgar categorically said that they did not return fire since they have no firearm and that he did not know what happened next since he was already hiding.

A certain person who was also on board the Toyota Fortuner bearing the surname Dela Pena told in an interview with Biliranisland.com that he and his other companions in the car took cover inside the car at the time of the encounter.

He told that he heard not only a single gunshot but several gunshots while they took cover inside the car for their safety.

After the encounter happened, members of the Philippine Army went to Barangay Tucdao to track down the suspected armed men involved in the encounter based on a video taken by Biliranisland.com.

In the video, one of the members of the army said that they went to Tucdao when they received a text message from a certain Junjun informing that the suspects were hiding in the area.

The army troops went and searched first the Tucdao barangay health station and after to the house of a certain Dory Tolentino in the video taken.

Said BI.com video showed three bullet holes in the Toyota Hilux, one at the left door and two at the rear left side of the said car while the rear left tire of the Toyota Fortuner was inflated, its rear windshield was broken and a bullet hole on its rear side was found.

Meanwhile, a person named Norbert Nierras, 46 years old, a resident of Bernardes Village, Naval, Biliran, a driver of Kawayan Mayor Rodolfo Espina, who was wounded in the encounter in Tucdao, was admitted in the Biliran Provincial Hiospital (BPH) at around 11 in the morning and is in critical condition.

In a statement, Kawayan Mayor Rodolfo Espina said they will just wait for the results of the investigation conducted by the members of the scene-of-the crime operatives (SOCO) who were now conducting an investigation of the incident in Tucdao, Kawayan.

BILECO wraps up May 2013 elections preparedness protocol

The Technical and Institutional Services Department personnel of the Biliran Electric Cooperative, Inc. attended the half-day operational plan briefing dubbed Oplan Bantay Kuryente 2013 in line with the forthcoming May 2013 national and local elections today, May 9, 2013 at the BILECO Kiosk, Caraycaray, Naval, Biliran.

As a deputized agency by the Commission on Elections (COMELEC), BILECO’s prime objective is to provide a reliable and efficient power supply throughout its coverage area a day before, during and after the conduct of elections.

Engr. Gerardo Oledan, Department Manager of the Technical Services, highlighted the need to follow protocols so as to keep with its mandate of delivering electric power as efficiently as possible. The key areas in the overall operation scheme that were addressed are power reliability, operational setup, communication tasks and procedures and security. Job and vehicle assignments were also introduced. Field personnel will be deployed to seven municipalities in the morning of May 12, Sunday, to advance the implementation of the Oplan until the evening of May 14, Tuesday.

Engr. Oledan added that with much anticipation on what may arise during the crucial period, the TSD had undertaken measures to allay, if not totally avoid disruptions and other forms of power failure. A close coordination with the COMELEC with regards to clustered polling precincts was established to ensure reliable power supply during the three-day period. Back-up generators in each municipality is also deemed part of the system plan. In the event of power shortage, commercial establishments, except media outlets and telcos, will be monitored as to their compliance of the voluntary load curtailment.

PNP personnel will also be deployed to the BILECO substation to ensure security to the pivotal area of operation. ISD likewise established a dedicated Communication Network Center (COMCEN) utilizing all available communication equipment such as VHF radio, landline telephone, cellular phones and internet to serve as the hub in monitoring the power status and relaying instructions to the field.

In his message, Mr. Marlon B. Roa, General Manager-CEO, expressed the need for team spirit during these times to fully attain the ultimate goal of delivering its monumental duty. He likewise emphasized that BILECO’s strenuous preparation for the election is not just a sheer compliance to the COMELEC or to the National Electrification Administration (NEA). Most notably, it’s a symbol of BILECO’s unremitting support and dedication towards achieving peaceful, clean and honest elections.

Eastern Visayas political families continue to rule

MAJOR ruling political families in Eastern Visayas are still assured to continue with their dominance on their respective turfs with the only exception of the Dazas in Northern Samar, ironically supposed to be the bailiwick of President Benigno Aquino III’s Liberal Party (LP).

In Leyte, the dominance of the Romualdez and Petilla families remain, as both Leopoldo Dominico Petilla and Ferdinand Martin Romualdez were unopposed on their respective bids for governor and congressman.

Petilla (LP) still managed to collect more than 300,000 votes, while Romualdez obtained 107,627 votes.

Romualdez (Lakas-CMD) was proclaimed last Wednesday at 5:45 p.m. while the members of the provincial board of canvassers proclaimed Petilla Thursday night.

Romualdez represents Leyte’s first congressional district, which includes Tacloban whose re-elected mayor, Alfred Romualdez, is a cousin.

What makes Alfred’s poll victory sweeter was his opponent, Representative Florencio Noel of the An Waray party-list group, was endorsed no less by the President and sister, Kris Aquino.

In Biliran, the smallest province of the region comprising of eight towns with a voting population of 104,712, is still dominated by the Espina family.

Both its governor, Gerardo “Boy” Espina Jr. (LP) and its lone congressional representative, Rogelio Espina (LP), trounced their respective rivals.

The re-elected governor obtained a total vote of 47,066 against his closet rival Niceto Limpiado (Pwersa ng Masa) who only obtained 25,095 votes. His elder brother Rogelio won over his old rival, ex-representative Glen Chong (Pwersa ng Masa).

Espina, who is seeking for his second term, obtained 46,072 against Chong’s 35,421 votes. Both were already proclaimed at 12:59 a.m. Thursday by the provincial board of canvassers.

Another brother tandem, this time in Southern Leyte, are sure to continue on their grips of the provincial political landscape.

Roger Mercado (National Unity Party) is enjoying a wide lead against his opponent, Robert Castañares (LP). Comelec counts disclosed that Mercado had 92,603 votes against Castañares’ 58,293 votes.

His brother, Damian (NUP), is also enjoying majority votes compared to his three rivals who included Rosette Lerias (LP), whose family had dominated the province for decades.

So far, Damian collected 85,919 votes while his closest rival, St. Bernard Mayor Rico Rentuza (Akbayan) has only 34,239 votes. Lerias, in the other hand, has 31,640 votes.

It is still a Tan country in Samar, which comprise of two cities and 21 municipalities, as three of its members appear to get re-elected.

Family matriarch, Milagrosa Tan (NPC), is on her way for a second term at the House of Representatives as she has obtained a big margin of vote against her opponent, Eunice Babalcon (LP).

As of Thursday morning, Tan has a total vote of 62,516 against Babalcon’s 52,209 votes. Her son, Vice Governor Stephen James (NPC), is sure to return to his post for the second term as he obtained 103,189 votes against his rival, former Basey town mayor, Wilfredo Estorninos’ 76,905 votes.

Governor Sharee Ann Tan (NPC), seeking for her second term, is still facing a tough battle with Aika Uy (LP) with only a few thousand of votes separating them.

So far, Tan managed to collect 106,948 votes, while Uy has 103,895 votes, a margin of 3,053 votes.

While the political families in the region are enjoying another fresh mandate from their respective electorate under allegation of massive vote-buying during election, it is not true in Northern Samar.

Based on Wednesday night’s tabulation of the provincial board of canvassers, Representative Raul Daza and his son, Governor Paul Daza, are on the losing side.

The Dazas, particularly the elder, are stalwarts of the ruling LP with no less than the President campaigned for their reelection.

The elder Daza appears to be defeated by his long-time political rival, Harlin Abayon. Latest poll count revealed that Daza has only 44,281 votes compared to Abayon’s 49,451 votes.

His son, Paul is heading for an exit after serving once as a congressman and now as a governor for a term. His rival, Jose Ong, is way above him by more than 35,000 votes.

So far, Daza has a total vote of 102,258 as against Ong’s 138,248 votes.

An ally of the Dazas, incumbent Vice Governor Ram Uy, is also losing heavily against Representative Emil Ong for the province’s second district.

Ong was proclaimed Thursday night with a total vote of 71,533 against Uy’s 46,988 votes.

Elsewhere in Eastern Samar, Ben Evardone was proclaimed Thursday night with 113,346 votes against his rival.

Naval town tops 2012 provincial nutrition evaluation

NAVAL, Biliran – Naval, the capital town in Biliran province is adding another feather on her cap as it topped the 2012 provincial nutrition evaluation among the eight towns in the province.

The municipality of Naval landed at the top based on the final results of the Monitoring and Evaluation on Local Level Plan Implementation (MELLPI) on Nutrition conducted recently.

MELLPI is an annual evaluation conducted by the members of the Biliran provincial nutrition committee (PNC) to assess the efficiency and effectiveness in the implementation of the programs, projects and activities geared towards improving the nutritional status of 0-71 month old children and schoolchildren.

The PNC in Biliran province conducted the annual MELLPI in the following municipalities with the corresponding schedules: April 15-Naval; April 16-Caibiran and Culaba; April 17-Cabucgayan and Biliran; April 18-Kawayan and Almeria; April 19-Maripipi; and April 22-consolidation of results of MELLPI.

The ranking of the eight towns in Biliran province based on the MELLPI results are as follows:Naval-71.86%;Almeria-70.64%;Caibiran-68.19%;Kawayan-66.52%;Maripipi-65.17%;Biliran-60.31%;Cabucgayan-56.09%; and Culaba-47.84%.

For her part, re-elected Naval Mayor Susan V. Parilla in a telephone interview was elated with the recent achievement of the municipality and thanked Dr. Fernando B. Montejo, municipal nutrition action officer (MNAO), as well as the other officials and employees of the municipality who have contributed for what the town has achieved in terms of getting the recent citation on nutrition.

Mayor Parilla told not to rest on what the town has achieved on nutrition but rather to continue working hard to be able to sustain said achievement in terms of the nutrition program of the town.

“Nutrition program of Naval is not only focused on children, though we give priority to them, but it is based on a holistic approach where everybody in the community can avail of and be benefitted”, Mayor Parilla stressed.

The lady chief executive of Naval town also emphasized to give more focus on the identified families with malnourished children in the municipality so that the town’s malnutrition problem will be properly addressed and solved. (PIA-Biliran)

NAVAL, Biliran – The Department of Public Works and Highways (DPWH) Internal Audit Service (IAS) from Central Office in Manila conducted a management audit of the Biliran District Engineering Office (BDEO) recently.

This was learned in a report sent to PIA-Biliran by BDEO through Engr. David Adongay, Jr., District Engineer.

He informed that the audit process conducted by DPWH-IAS focused more on planning, programming, design, eligibility, bidding, awarding and contracts process; receipt and utilization of funds; receivables and payables; as well as supply and property management.

Led by Mr. Romualdo Suyom, supervisor, the audit team completed its work in a period of nine days.

Engr. Adongay said that the objectives of the audit were to appraise whether internal control components at the BDEO were well designed and properly implemented; evaluate whether internal control objectives were achieved and; evaluate the control effectiveness of operating system and support systems for a specific period or date.

Furthermore, he said that the management audit is one of DPWH’s way of evaluating the performance of every DPWH unit whose concern is the effectiveness and economy in the use of resources with reference to efficiency and in accordance with applicable regulations which is Management Accountability.

The audit was started with a conference on the first day of the audit process with key officials of BDEO and the audit team. Said conference was held at the BDEO conference room, said Engr. Adongay.

The DPWH internal auditors from IAS scrutinized BDEO in every aspect of the audit points for nine days.

The audit ended with an exit conference.

In a phone interview with Engr. Adongay today, he said “the results of the audit was very inspiring, although, there were some points given by the audit team to BDEO that need to be improved and strengthened”.

Donations continue to pour in for NCS brigada eskwela 2013

NAVAL, Biliran – “Donations continue to pour in for the Naval Central School (NCS) Brigada Eskwela 2013 since it started on Monday, May 20,” said Herman Donato, school principal, in an interview with PIA-Biliran.

He informed that as of Thursday, May 23, two days before the weeklong Brigada Eskwela ends, NCS has received more donations in kind from generous donors, parents and private organizations.

“The donations especially construction materials will be used for minor repairs and maintenance of school buildings and other fixtures of the school. Members of the community where the NCS is located likewise gave their donations like hollow blocks, cement, paint, among others for the same purpose,” he said.

Brigada Eskwela is a nationwide voluntary effort that brings together teachers, parents, students and sectors in the community to do clean up and repairs in public schools to prepare the school facilities just in time for the school opening in June.

“Through the years, since the Brigada Eskwela started in 2003, the participation of the different sectors in the community at the NCS has increased,” he added.

Undertaken in all public schools every third week of May, two weeks before classes begin, Brigada Eskwela is participated by different sectors, to include local government agencies, local business and other groups.

Volunteers do various work inside the school campus like repainting of classrooms, furniture repairs, clean up of school grounds and many other tasks.

Brigada Eskwela is an activity where true “bayanihan” spirit is demonstrated by the volunteer sectors in the community.

Now on its 10th year, Brigada Eskwela carries the theme “Isang Dekada ng Bayanihan sa Paaralan. (PIA 8 Biliran)

NAVAL, Biliran – The Commission on Elections (COMELEC), Biliran Provincial Office is set to hold an evaluation and exit conference on the recently concluded May 13, 2013 Automated Synchronized National Elections in Biliran province.

“The evaluation conference will give us the opportunity to revisit the problems encountered and the good practices initiated before, during and after elections”, said Atty. Sabino Mejarito, Provincial Election Supervisor (PES) of Biliran in a letter-invitation sent to the Philippine Information Agency (PIA), Biliran Provincial Information Center..

Atty. Mejarito informed that part of the exit conference that will be conducted on Thursday, May 30 at 9:00 o’clock in the morning at the Nipa Hut Complex, capitol compound in Brgy. Calumpang, Naval is a get-together of all COMELEC deputies who, despite their busy schedules in their respective offices, shared and volunteered their effort and time to make the May 13, 2013 national and local elections in the province of Biliran successful.

The agenda of the evaluation and exit conference include the presentation of the results of the elections in Biliran province to be given by COMELEC through Atty. Mejarito.

Also part of the activity is the sharing of election experiences by agencies and organizations involved, particularly on problems encountered and the solutions and recommendations adopted.

“Good practices adopted during the May 13 elections can be applied in future elections that will be conducted”, he said further.

THE Bangko Sentral ng Pilipinas’s Monetary Board (MB) recently placed the Rural Bank of Naval in Biliran province under the Philippine Deposit Insurance Corp.’s (PDIC) receivership, making the lender the eighth to close this year.

In a statement issued late last week, the PDIC said it took over the bank on Friday by virtue of MB Resolution 866.A, dated May 30. It added that all the bank’s records had been gathered, verified and validated.

The lender has its head office in P. Burgos St. in Naval town and a branch in Carigara town, Leyte province.

Latest available records show that as of end-March, the bank has 2,984 accounts with total deposit liabilities of P137.97 million. A total of 2,944 or 98.7 percent of its deposit accounts have balances of P500,000 or less and are fully covered by deposit insurance. Total insured deposits amounted to P79.48 million or 57.6 percent of total deposits.

According to its latest information sheet, dated December 31, 2012, the lender is majority-owned by Jane Jean Diu (7.94 percent), Demetrio A. Jaguros (7.79 percent), Catalina T. Velasquez (7.33 percent), Cecilia T. Junia (6.57 percent), Cherry B. Enage (4.71 percent), Chairman and President/Manager Rizalito V. Curso (4.67 percent), Tomas Matiga (4.38 percent), Juan V. Pastor (4.05 percent) and Vicente C. Curso Sr. (3.94 percent).

The Rural Bank of Naval is the latest provincial lender to be shuttered this year, after Capital City Bank in Cavite province on January 24, the Rural Bank of Gainza in Camarines Sur province on February 1, the Rural Bank of Majayjay in Laguna province on February 8, the Rural Bank of Buenavista Inc. in Agusan del Norte province on March 4, La Consolacion Rural Bank Inc. in Laguna on March 15, the Rural Bank of Kinogitan Inc. in Misamis Oriental province on March 27 and the Cooperative Rural Bank of Bulacan on May 24.

The PDIC has assured depositors that all valid deposits shall be paid up to the maximum deposit-insurance coverage of P500,000.

The state deposit insurer will hold depositors-borrowers forums from June 5 to 6 to inform depositors of the requirements and procedures for filing deposit-insurance claims. Claim forms will be distributed during the forum.

The schedule and venue of the forums will be posted in the bank’s premises and on the PDIC web site (www.pdic.gov.ph). Claim forms, as well as requirements and procedures for filing, can be downloaded from the site.

Depositors may update their addresses with PDIC representatives at the bank or during the forums using the mailing address update forms that will be furnished by the state deposit insurer. Once filled out, these forms should be submitted to the representatives, accompanied by a photo-bearing ID of the depositor with signature.

Depositors have until June 7 to update their addresses.

Depositors with valid deposit accounts with balances of P15,000 and below need not file deposit-insurance claims. Those who do are those with outstanding obligations with the rural bank, have incomplete addresses and have yet to update their addresses with the lender.

The PDIC aims to start mailing payments to those who don’t need to file claims by the second week of June. For those who do, the state deposit insurer targets to begin claims-settlement operations by the fourth week of the month.

The schedule of these operations will be announced through notices to be posted in the bank’s premises and other public places, as well as on the PDIC web site.

TACLOBAN CITY – The Monetary Board (MB) of the Bangko Sentral ng Pilipinas (BSP) has closed down the Rural Bank of Naval, Inc. on Thursday, the Philippine Deposit Insurance Corporation (PDIC) disclosed in its website.
The state deposit insurer also announced that it will conduct depositors-borrowers forums on June 5 and 6, 2013 to inform depositors of the requirements and procedures for filing deposit insurance claims.

The BSP stops bank operations if they have insufficient liquid assets to meet liabilities or cannot continue doing business without involving losses to depositors or creditors.

The Rural Bank of Naval has its main office located at P. Burgos St., Naval, Biliran. Its lone branch is in Carigara, Leyte with about 446 depositors. As of March 31, 2013, the bank had 2,984 accounts with total deposit liabilities of P137.97 million in both Naval and Carigara branches.

“Upon takeover, all bank records shall be gathered, verified and validated. The PDIC assured depositors that all valid deposits shall be paid up to the maximum deposit insurance coverage of P500,000,” the PDIC said in a statement posted in its website.

Of the total number of depositors, 98.7% or 2,944 deposit accounts have balances of P500,000 or less and fully covered by deposit insurance.

A PDIC official said in a phone interview that since Friday afternoon, they have been examining bank records in the head office in Naval, Biliran and branch office in Carigara, Leyte.

“After the examination process, we will immediately start the release of insurance claims. It will main depend on the availability of records,” a insurer official said who requested anonymity because he is not authorized to speak on the issue of closure.

Depositors with valid deposit accounts with balances of P15,000 and below need not file deposit insurance claims. For those with small accounts, PDIC targets to start mailing payments to depositors within the next two weeks.

For depositors with balances of more than P15,000, they are required to file deposit insurance claims. The PDIC’s timetable to start claims settlement is no later than the last week of June.

The state deposit insurer said that claim forms will be distributed during the Forum. The schedule and venue of the Forum will be posted in the bank premises and in the PDIC website,www.pdic.gov.ph.

Citing the latest bank information sheet, the PDIC said bank was majority-owned by Jane Jean Diu (7.94%), Demetrio A. Jaguros (7.79%), Catalina T. Velasquez (7.33%), Cecilia T. Junia (6.57%), Cherry B. Enage (4.71%), Rizalito V. Curso (4.67%), Tomas Matiga (4.38%), Juan V. Pastor (4.05%) and Vicente C. Curso, Sr. (3.94%).

Rizalito Curso served as the chairman, president and manager of the bank.

NAVAL, Biliran – The Philippine Deposit Insurance Corporation (PDIC) will hold a forum for the depositors and borrowers of the Rural Bank of Naval, (RBN) Incorporated that was closed on May 30, 2013 and was placed under receivership of PDIC to answer queries relative to their existing accounts with the bank.

Nathanael A. Tombokon, information officer of PDIC, disclosed in a telephone interview that the forum that will be conducted at 9’00 o’clock in the morning on Wednesday, June 5, 2013 at the IT and Multimedia Center of the Naval State University (NSU) is the proper venue where the bank’s clients can raise their questions to the PDIC officials present in the forum.

Tombokon disclosed that RBN was officially closed by virtue of Resolution 866-A of the Monetary Board of the Bangko Sentral ng Pilipinas (BSP) on May 30, 2013 and is placed under PDIC receivership on May 31, 2013.

However, the PDIC information officer did not reveal the reason for the closure of the bank since he said “it is the BSP that determined and knew the reasons for its closure”.

He assured that PDIC will start releasing through postal money order the insured deposits of bank depositors who have deposits ranging from P15,000 and below by the second week of June 2013. Only a mailing address update form now available at RBN is required from a depositor to fill-up to ensure that the postal money order of the insured deposit will surely reach the depositor.

“For depositors who have deposit in the bank from P15,000 up to P500,000, the depositor will just fill-up a claim form which will be distributed during the forum, submit two valid identification cards and present the depositor’s bank passbook”, Tombokon added.

PDIC will start releasing the insured deposit through postal money order to depositors who have P15,000 up to P500,000 deposit by last week of June this year.

He further said that the excess of the P500,000 deposit called “uninsured deposit” can still be claimed by a depositor depending on the rehabilitation plan to be submitted by the RBN management to BSP.

“Uninsured deposits can still be claimed against the asset or after liquidation of all the bank’s assets which will take a longer period”, Tombokon said. (PIA-Biliran)

Comelec official calls for massive voters education, keep away from politicians

NAVAL, Biliran – The top official of the Commission on Elections (Comelec) in Biliran province has emphasized two things to the deputized agencies of the commission: massive voters education and keep away from politicians.

Atty. Sabino C. Mejarito, provincial election supervisor of Comelec-Biliran conveyed this message before the representatives of the different deputized agencies here in Biliran province in an evaluation and exit conference held recently at the Nipa Hut complex at the provincial capitol compound.

Mejarito made the remark after evaluating that Comelec-Biliran and its deputies have only reached “more than half” of what it desired to attain in the conduct of the May 13, 2013 synchronized national and local elections.

“First, is to have a massive voters’ education pertaining to their important role as citizens in a democratic society”, Mejarito stressed.

He said that voters must know that the future of the country lies in their hands and implied “it is pitiful for the next generation if the country where they grow is already in the claw of unscrupulous and unmindful leaders”.

Mejarito also pointed out to the deputies to keep away from politicians since this country relied on the people who are duty-bound by law in implementing and securing the elections.

“If we have to engage in the dirty game of politics, to whom this country will rely to?” he further emphasized with a note that the majority must stay in the middle to implement the election laws.

The top official of Comelec-Biliran admitted that there were lots of problem in the election and stressed that “Comelec personnel alone cannot fix it”. He likewise challenged his co-workers in Comelec-Biliran to work hard to strengthen the people’s trust and confidence.

“We have witnessed the different kinds of manipulations of would-be politicians or private citizens in order that their candidates may have an edge or win as if their candidates will be elected, everybody will turn good and change will be achieved” Mejarito further observed in the May 13, 2013 synchronized national and local elections.

However, Mejarito disclosed that if all of those who win got elected because they buy votes, then we could not expect change.

He also cited in his message an election ruling inculcating the role of voters in a democratic society reminding them that the Constitution provided that sovereignty resides in the people and that all government authority emanates from them and that their exercise of the power of suffrage provided by the Constitution will be a myth if it is not voluntary and free.

The ruling added that the power of suffrage must be zealously guarded against all attempts to prostitute it. Otherwise, it would permit the evil force to gnaw into the very structure of government and ultimately destroy its foundation, Mejarito cited. (PIA-Biliran)

Former mayor, accountant of Caibiran sentenced from 6-10 years for graft deal

TACLOBAN CITY- A former mayor in Biliran province was convicted by the Sandiganbayan for graft involving an amount of P160,000 for an alleged ghost project.

Found guilty by the first division of the Sandiganbayan was Melchor Maderazo who served as officer-in-charge mayor of Caibiran town.

Also convicted by the anti-graft court was former municipal accountant Dionesion Veruen Jr. Both were sentenced to six to 10 years imprisonment with perpetual disqualification from holding public office.
The decision of the Sandiganbayan stemmed from a transaction involving the release of P160,000 which represented the cost of a project involving 400 pieces of tapping saddles (steel pipe connectors) that were not actually delivered.

The materials were supposed to be used for a water system project of the town.

The two were directed to pay the amount of P160,000 to the local government of Caibiran.

The Sandiganbayan, on its decision issued last May 30, held that the two defrauded the local government after the alleged contractor of the project,Artemio Vermug, testified that Maderazo forced him to sign a contract and endorse a check amounting to P160,000 but was not asked to do the actual work.

It also held that Maderazo could not have succeeded with the crime without the cooperation and participation of Veruen because they both signed the disbursement voucher, the Land Bank of the Philippine check and the false inspection report that was submitted as liquidation for the “ghost delivery” of the tapping saddles. Aquinos, other political clans rule mid-term polls

Filipino voters all expect reforms that will lift the country from poverty and other extreme economic conditions in the years ahead but the results of the recent elections concentrated on political power to traditional political clans limiting the prospects for a democratized system in government to institute changes.

In an analysis, the Center for People Empowerment in Governance (CenPEG) said that for any substantial reform to happen, political authority and government machineries must first be democratized whereby the people’s representation in policy making is effectively ensured.
It said such a pre-condition did not happen in the recent mid-term elections.

“Not only did the elections allow a significant number of political clans back in power but it also led many of them to become more entrenched with more members per family winning elective positions across several territorial jurisdictions and in terms of higher posts they will occupy,” it said.

In the recent elections, several nationally-known political dynasties fielded more of their members running for different national (Senate and House) and local positions (from governor, to mayor, vice-mayor, and councilors) in several towns.

“These dynasties had from 8 to as many as 20 members running but none could beat the number of candidates coming from the Ampatuan clan in Maguindanao province, with 74. Opportunistically, they ran under different traditional political parties, whether administration or “opposition”,” it noted.

Seven members of the Aquino-Cojuangco clan in Tarlac are in public office, with Bam Aquino in the Senate aside from Benigno S. Aquino III in Malacanang, it noted.

Partial results of the mid-term elections show some of the biggest gainers, led by the Binays of Makati with a new senator, congresswoman, and reelected Makati mayor aside from the incumbent vice president himself; Singsons of Ilocos Sur, nine wins (including two congressmen and one governor), no loss; Ortegas of La Union, six wins (including one congressman and one governor); Dys of Isabela, six wins, no loss (including one congressman, one governor, and three mayors); Pinedas of Pampanga, governor, vice-governor, and councilors;

Espinas of Biliran, six wins, no loss (including one congressman, one governor, one mayor); Tupases of Iloilo, seven wins out of 13, including one congressman, one vice-governor, and several councilors; Ynares of Rizal, one governor and two mayors; Dimaporos of Lanao del Norte, five wins, no loss (including two House seats, one governor, one mayor); Romualdos of Camiguin, three wins, no loss (one House seat, governor, and mayor); and Mangudadatus of Sultan Kudarat and Maguindanao, with 10 candidates so far winning out of 19 fielded (including two governors, one House seat, and several mayors and councillors).

Seventy-four members of the Ampatuan clan in Maguindanao ran with 23 of them so far getting elected including the wives of three town mayors now jailed for the Nov. 2009 massacre case. Another son, Benzar, who is also detained was re-elected mayor. The richest member of the lower House, boxer-turned politician Manny Pacquiao, was also re-elected and now packs a new dynasty, with wife Jinkee as new Sarangani vice-governor and protégé, Ronnel Rivera, son of a fishing magnate, as new mayor of Gen. Santos City. The 1-2-3 punch floored the Antonino-Custodio clan of South Cotabato.

The next Senate will also host two political families with two members each – the Cayetanos and Estradas. The Estradas also took two mayoralty posts – San Juan and Manila, with former president Joseph E. Estrada. The Senate seats soon to be vacated by Edgardo Angara and Manny Villar will be occupied by son Sonny and wife Nancy, respectively.
CenPeg said the dominance of political dynasties in the Senate has increased from 85 percent in the current 15th Congress to 87 percent in the new Senate – excluding three senators.

Meanwhile, two members of the Macapagal-Arroyo family retained their seats – discredited president Gloria M. Arroyo (Pampanga) and son Dato (Camarines Sur).

A few political clans lost in all contests, including the Gordons of Olongapo, Payumos of Bataan, Dazas of Northern Samar, and Tañadas of Quezon.
On the other hand, two out of five members of the Jalosjos family in Zamboanga del Norte won – a House seat and Dapitan mayor.

Other dynasties cannot be counted out yet, despite some setbacks: the Garcias lost the governorship of Cebu but won one House seat and two mayoralty posts; Migz Zubiri lost his Senate bid but two other members of the Zubiri family of Butuan won the governorship and one House seat.
The debacles suffered by some clans did not signal the end of dynastic rule. Most candidates from these clans lost their seats either to their own relatives or rivals coming from similar traditional political parties.

“The Dazas of Northern Samar, for instance, were trounced by the Ong family, who took the House seat, governorship, and mayoralty of Laoang town. As shown by the Marcoses, political dynasties are resilient and are able to recover their losses – and still multiply – after some time,” according to CenPeg.

It added that in many provinces and districts, candidates from political dynasties ran unopposed.

“Third party coalitions tried to field their own senatorial slates but could not match the traditional advantages of the ruling political clans – family name recall, voter awareness, and resources. In many areas, local contests were decided by widespread vote buying and, in some places, by intimidation involving local dynasties and their private armies,” CenPeg added.

There were also reports of automated fraud ranging from pre-shading and pre-loading of ballots, offers by local election officials to make candidates win, and unexplained long brownouts in many vote-rich provinces on election day, it said.

It also noted that similar to the 2010 presidential elections, voters could not really tell who won and who lost in the recent mid-term elections.
Comelec used a different approach: Chairman Sixto Brillantes, Jr. was quoted by the press as saying that the proclamation of winning senatorial candidates was based on vote projection and not on the 100 percent completion of certificates of canvassing (COCs).
“We rely not on the exact number of votes but on the projected number of votes [that] we anticipate,” he said.

“Thus, the proclamation of the 12 Senate winners was made despite the failure to electronically transmit 18,000 election returns (ERs) representing about 9 million voters. And yet 9 million votes can technically change the rankings in the Senate,” it said.

The credibility of the mid-term elections was tainted by Comelec’s and Smartmatic’s removal of major safeguards and security features of the poll automation system, the repeated non-compliance of election laws including the timely independent source code review, the PCOS machines’ systematic and widespread transmission failures, the highly irregular and arbitrary decisions on the RMA, illegal CF cards and their physical transport to the NBOC, and the premature proclamation of election winners, CenPeg said.
CenPeg said all these conditions are what make an election failure.
The questionable performance of the Comelec-managed poll automation was as predictable as the election process itself, it added.

The playing field was uneven from the beginning, therefore, the election could not qualify as fair and democratic reflective of the voters’ sovereign will. Only an election that is fair and promotes the competition of platforms and track record and not decided by popularity and money can qualify as democratic.

Moreover, the right of suffrage was violated on account of the poll automation’s disabling of transparent features that would have allowed every voter to see in his own eyes how his vote is counted.

The absence of the legally-mandated digital signature compromised the validity of all election returns and this alone serves as a legitimate ground for questioning the election results, CenPeg said.

Thus, the recycling of political dynasties was a foregone conclusion. Political dynasties, by and large, perpetuate themselves in power through elections made farcical by being undemocratic and now by an illegitimate automation process that is unable to modernize let alone democratize the public exercise that is administered by a hostile and incompetent election body, it added.

Having concluded the mid-term elections, the first priority of the country’s dominant political oligarchs is to gear up for the 2016 presidential derby three years from now.

The consolidation of political gains in Congress, such as the new Senate presidency, and the league of local government unit (LGU) officials will be the main agenda of both the administration and the “opposition” bloc.

As expected, the agenda for genuine social and economic reform will be sidelined no matter the economic deterioration, joblessness, and worsening poverty in the country.

The representation of the poor in government has been further eclipsed by the dominance of the political dynasties whose power is now boosted by the anti-people ruling of the high court opening the Party-list system to the high and mighty, according to CenPeg.

Real development requires the distribution of wealth and an end to the concentration of wealth by the small elite. This can happen if the political system allows the distribution of power under the principle of a people-based and rights-driven government. When none exists, a country will continue to wallow in poverty and social inequities. Where oligarchies rule real development cannot take off. A classic case is the Philippines, it said.
